Consumer group giant L’Oreal has decided to again tackle the problem of their good being sold on the trading site Ebay. brand image is a major concern for L’oreal as the items sold on Ebay could well be fake and harmful to users. The items for sale on Ebay could also have been sources from some place other that Europe and therefore would neccarily comply to the required controls and taxes. This issue particularly an issue for L’Oreal’s perfume shop section
These global companies are certainly no strangers, having met in court a number of times. They have met over similar issues in the past and Ebay has largely come out on top. A court case that was brought against Ebay in Belgium was won by the Internet trading site.
The nature of Ebay’s functioned as been brought into question by other companies who feel it is open to easy abuse. Names such as Apple, Adidas and Rolex have also seen a problem with Ebay’s seemingly relaxed attitude to uncontrollable selling of goods and court action has been faced before by the interactive trading site.
There are already mixed results that have come out of court cases against Ebay and this causes problems for the authorities as they have not set guidelines on which to go by. They seem to have treated each case individually and on its own merits and whilst this may be the best option in some people eyes it does not allow for standard practices to be established and will likely lead to further action being taken against Ebay by companies who also think the service is detrimental to their business.
The French company L’Oreal are thought to be taking their case to London’s High Court and launching a trademark infringement appeal. Among the products that L’Oreal will cite are Lipstick, perfume samples, hair products and eye makeup. Ebay is predicted to argue a similar point as it has before and point out that it simply serves as an another route to market and can actually help companies boost their profits.
